Girlfriend ordered to pay Shs15m to boyfriend after using the funds intended for business as upkeep

Law Development Centre Court Principal Magistrate Martin Kirya has ordered Patience Ngaimita to reimburse her boyfriend, Isaac Kumakech, with a total of Shs15,952,335. This judgment comes in response to Ngaimita’s misuse of the Shs14,952,335 intended for a bar and restaurant business for her personal expenditures.

Isaac Kumakech initiated legal proceedings against his girlfriend, Patience Ngaimita, seeking court intervention to reclaim the funds he had sent her to establish a bar and restaurant business.

According to court records, the couple initially met on Facebook and developed a close relationship that eventually led to a marriage proposal. At the time, Kumakech was pursuing a master’s degree in the United States, while Ngaimita was employed at a bank in Mbale.

The two reached an agreement in which Ngaimita would resign from her job to initiate a business venture. Subsequently, she relocated to Mbalwa in Kira Municipality.

Kumakech began sending money to Ngaimita’s mobile number, and they also established a company called Living Room Company Limited, where both held directorship positions.

However, Kumakech expressed disappointment upon discovering that Ngaimita had diverted the funds for personal purposes.

In her defense, Ngaimita contended that the money sent to her was intended for personal upkeep rather than business expenses. She further argued that Kumakech had not responded to her business proposals.

In delivering his verdict last Friday, Principal Magistrate Martin Kirya indicated that Ngaimita had deceived her boyfriend, citing the substantial sums of money and the timing of their transfer, which indicated an intended investment.

Additionally, he noted that Ngaimita had used a fabricated resignation letter, further deceiving Kumakech. The magistrate ordered Ngaimita to repay Shs14,952,335, along with an additional Shs1 million for her fraudulent actions.
