Court orders DNA test on Mabirizi and siblings over his exclusion from late father’s will

Mukono Grade One magistrate, Paul Matyama, has issued a ruling mandating controversial lawyer Male Mabirizi and his siblings to undergo a DNA paternity test to determine their biological relationship with their late father.

The decision comes after the Chief Magistrates Court in Mengo invalidated the funeral proceedings led by one of the late Mohammad Bazinduse Mutumba’s sons, Pastor Solomon Male, due to Mabirizi’s absence during the event. Mabirizi had been incarcerated at the time and contested the distribution of his father’s property, which he claimed rightfully belonged to him, challenging his sibling Nalutaaya Stella’s possession of it.

The court ruled that conducting the funeral and distributing Mutumba’s assets in Mabirizi’s absence was a contemptuous act aimed at altering the legal status quo and rendering the lawyer’s previous application moot.

Drawing from the Chief Magistrates Court’s ruling, Mabirizi filed an application in Mukono, seeking an exhumation order for his late father Mohammed Mutumba’s remains. The burial took place on June 21, 2022, in Ndese village, Ndese town, Seeta Namuganga sub-county, Mukono district.

The exhumation request intends to extract a portion of Mabirizi’s father’s skeletal remains to conduct a DNA test involving all his siblings, aiming to establish their biological relationship with their late father.
