“You cannot be filing and withdrawing cases at leisure,” Court stops Lawyer Mabirizi from filing endless cases

From suing the Kabaka, challenging President Museveni’s candidature to questioning Robert Kyagulanyi’s academic documents, maverick lawyer Male Mabirizi seems to be doing it all on the legal scene as he’s always filing a case in the courts of law.

However, his continuous filing of cases must have ‘nagged’ the judiciary as the High Court’s Civil Division,Judge Musa Ssekaana has ordered the Registry not to allow him Mabirizi to file any other case.

Ssekaana accuses Mabirizi of filing ‘duplicated’ cases that he refiles and withdraws at leisure.

In a letter to the lawyer, Ssekaana says that Mabirizi duplication of cases is an act of abuse of the court processes and thus issued strict orders to the Registry staff as far as Mabirizi’s case filings are concerned.

“This division will not allow you to abuse the court register by filing and withdrawing cases at leisure and refiling later in order to be allocated to another judge. Your actions and practices amount to forum shopping which is strictly abhorred by this court,” reads the letter in part.

In response, Mabirizi has warned the Judge informing him that it was unlawful to order the Registry not to receive his files.

“Reading your letter proved your misconduct, misbehaviour and incompetence, as I complained against you early last year with the Judicial Service Commission, with investigations on going.”

He added that the head of the High Court’s Civil Division is not immune to prosecution and therefore informed him not to get surprised if he drags him to court on criminal charges.
