Ruparelia Group Managing Director Rajiv Ruparelia has hit back at DFCU Bank over breach of customer confidentiality and defamatory allegations the bank made against him.
Through his lawyers Walusimbi & Co, Advocates, Rajiv has written to DFCU Bank asking them to retract a Legal Notice dated October 5th, 2018 where the bank’s lawyers claimed he was sponsoring several online publications to publish negative stories about the bank.
In the DFCU notice drawn by M/S Kalenge, Bwanika, Sawa & Co. Advocates, Rajiv’s personal mobile number was made public and his lawyers say this is tantamount to breach of customer confidence.
“Our client’s attention has been drawn to various social media publication through your agents M/S Kalenge, Bwanika, Sawa & Co. Advocates clearly expressing themselves to be acting on your instructions wherein they to his regret and enormous inconvenience published and widely circulated among others his phone number – a detail otherwise given to you in confidence tied to his account held with yourselves by virtue of having succeeded the same from the Crane Bank Limited (in receivership).
Rajiv’s lawyers say their client begrudges DFCU’s breach of confidence warning that it is actionable both civilly and criminally.
“Our client … requires an immediate formal apology similarly shared on all platforms hitherto published to, together with atonement for the same ail not later than clos of business this week,” the legal notice signed by counsel Nelson Walusimbi reads in part.
Rajiv’s lawyers also demand a retraction of DFCU’s lawyer’s statement.
